El Ministerio Federal de Justicia (BMJV) desea hacerlo, seg\u00fan un documento presentado al <a href=\"https:\/\/www.spiegel.de\/netzwelt\/netzpolitik\/neues-gesetz-soll-kampf-gegen-darknet-handel-erleichtern-a-274b8f29-ca90-4504-9e7e-39e68cf1a6a9\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Espejo<\/a> est\u00e1 disponible, c\u00e1mbielo de manera oportuna. En el proyecto de ley que la BMJV, encabezada por la Ministra de Justicia Christine Lambrecht (SPD), ha redactado, se ha creado un nuevo delito penal. Concretamente, se condenar\u00e1 a las personas que \"operen una plataforma comercial en Internet cuyo prop\u00f3sito sea permitir o promover la comisi\u00f3n de actos il\u00edcitos\". La pena ser\u00e1 de entre cinco y diez a\u00f1os en los casos comerciales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Planes similares tambi\u00e9n estaban contenidos en la Ley de Seguridad de la Tecnolog\u00eda de la Informaci\u00f3n 2.0, la cual, sin embargo, fue eliminada nuevamente en mayo de 2020. Originalmente, la iniciativa legislativa ya fue aprobada por el Bundesrat en marzo de 2019.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-schutz-vor-kriminellen-oder-gefahr-f-r-provider\">\u00bfProtecci\u00f3n contra los delincuentes o peligro para los proveedores?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">El Comisario Federal de Protecci\u00f3n de Datos, Ulrich Kelber, entre otros, critic\u00f3 la ley de seguridad inform\u00e1tica 2.0 porque tem\u00eda que la ley no s\u00f3lo se dirigiera contra los delincuentes, sino tambi\u00e9n <a href=\"https:\/\/webhosting.de\/es\/\">Anfitri\u00f3n de la web<\/a>que, sin su conocimiento, han dado a los operadores de los mercados ilegales <a href=\"https:\/\/webhosting.de\/es\/server_vm\/\">Servidor<\/a> ...a disposici\u00f3n de la empresa, amenazado. Los defensores de los datos y los activistas de los derechos civiles temen ahora una situaci\u00f3n similar con el nuevo proyecto de ley, que se va a insertar como art\u00edculo 127 en el C\u00f3digo Penal alem\u00e1n (StGB).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sin embargo, a diferencia de la Ley de Seguridad Inform\u00e1tica 2.0, la enmienda actual de la ley s\u00f3lo estipula que se castiga el funcionamiento de los mercados con una \"orientaci\u00f3n claramente delictiva\". Anteriormente, la ley establec\u00eda que incluso la \"oferta de servicios para posibilitar actos delictivos\" es ilegal, lo que pondr\u00eda en peligro a casi todos los anfitriones de nubes. La sanci\u00f3n por ello fue en la Ley de seguridad inform\u00e1tica 2.0 para \"los proveedores de un servicio basado en Internet cuyo prop\u00f3sito o actividad est\u00e9 encaminada a permitir o promover la comisi\u00f3n de actos il\u00edcitos\". Con hasta tres a\u00f1os de prisi\u00f3n.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-normale-provider-nicht-betroffen\">Los proveedores normales no se ven afectados<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De acuerdo con la enmienda propuesta actualmente para la ley, existe la amenaza de <a href=\"https:\/\/webhosting.de\/es\/los-mejores-proveedores-de-computacion-en-nube\/\">Proveedor<\/a> y los mercados \"con un prop\u00f3sito comercial legal\" no imponen sanciones, aunque en raras ocasiones su infraestructura haya sido utilizada indebidamente por los delincuentes para cometer delitos. La orientaci\u00f3n delictiva debe identificarse, entre otras cosas, por la presentaci\u00f3n del sitio y las categor\u00edas de venta ofrecidas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Seg\u00fan la BMJV, el objetivo del proyecto de ley es facilitar la recaudaci\u00f3n de dinero de los delincuentes condenados. En combinaci\u00f3n con las penas de prisi\u00f3n significativamente m\u00e1s altas, esto deber\u00eda disuadir a los operadores de los mercados ilegales y <a
