{"id":6452,"date":"2020-12-11T21:06:46","date_gmt":"2020-12-11T20:06:46","guid":{"rendered":"https:\/\/webhosting.de\/?p=6452"},"modified":"2020-12-11T21:06:48","modified_gmt":"2020-12-11T20:06:48","slug":"youtube-no-debe-ser-legal-cargas-sin-direccion-ip-emitida","status":"publish","type":"post","link":"https:\/\/webhosting.de\/es\/youtube-muss-bei-illegalen-uploads-keine-ip-adressen-rausgeben\/","title":{"rendered":"YouTube no tiene que dar direcciones IP para las subidas ilegales"},"content":{"rendered":"<p class=\"wp-block-paragraph\">El Tribunal Federal de Justicia (BGH) ha dictaminado en un <a href=\"https:\/\/www.bundesgerichtshof.de\/SharedDocs\/Pressemitteilungen\/DE\/2020\/2020159.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Juicio<\/a> (Asunto n\u00ba I ZR 153\/17), de 10 de diciembre de 2020, dictamin\u00f3 que las plataformas como YouTube solo deben revelar los nombres y direcciones de los usuarios en caso de infracci\u00f3n de los derechos de autor. M\u00e1s informaci\u00f3n en <a href=\"https:\/\/webhosting.de\/es\/personenbezogene-daten-sozialen-netzwerken\/\">Datos<\/a> como direcciones de correo electr\u00f3nico, n\u00fameros de tel\u00e9fono o <a href=\"https:\/\/webhosting.de\/es\/ip-adresse\/\">Direcci\u00f3n IP<\/a> puede, sin embargo, ser retenido del titular del derecho. El fallo del BHG corresponde, por tanto, a la sentencia del Tribunal de Justicia de las Comunidades Europeas (TJCE) de julio de 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El caso concreto se refer\u00eda a dos pel\u00edculas de la empresa distribuidora Constantin Film, que un usuario de YouTube hab\u00eda publicado en la plataforma de v\u00eddeo. La empresa exigi\u00f3 entonces que la filial de Google entregara el nombre completo y la direcci\u00f3n del usuario. YouTube explic\u00f3 entonces que esos datos no se recogen y, por lo tanto, no se pueden entregar. Constantin-Film exigi\u00f3 entonces que se entregaran la direcci\u00f3n de correo electr\u00f3nico, el n\u00famero de tel\u00e9fono y la direcci\u00f3n IP para poder identificar al usuario de YouTube.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-youtube-speichert-telefonnummern-und-ip-adressen\">YouTube almacena n\u00fameros de tel\u00e9fono y direcciones IP<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Al registrarse, YouTube exige a sus usuarios que proporcionen no s\u00f3lo su direcci\u00f3n de correo electr\u00f3nico sino tambi\u00e9n su nombre y fecha de nacimiento, as\u00ed como su consentimiento para el almacenamiento de su direcci\u00f3n IP. Sin embargo, los datos proporcionados no se verifican. Adem\u00e1s, los usuarios deben proporcionar un n\u00famero de tel\u00e9fono si quieren subir v\u00eddeos de m\u00e1s de 15 minutos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El BGH justific\u00f3 su decisi\u00f3n afirmando que <a href=\"https:\/\/dejure.org\/gesetze\/UrhG\/101.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">P\u00e1rrafos 101<\/a> de la Ley de Derechos de Autor no incluye el derecho a la informaci\u00f3n sobre n\u00fameros de tel\u00e9fono y direcciones de correo electr\u00f3nico de los usuarios.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>\"Tampoco incluye informaci\u00f3n sobre los archivos utilizados para cargar los archivos infractores <a href=\"https:\/\/webhosting.de\/es\/muessen-webhoster-die-ip-adressen-ihrer-kunden-herausgeben\/\">Direcciones IP<\/a> o las direcciones IP utilizadas por \u00faltima vez por los usuarios de los Servicios para acceder a su cuenta\".<\/p><cite>TRIBUNAL SUPREMO FEDERAL<\/cite><\/blockquote><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">El <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/HTML\/?uri=CELEX:32004L0048R(01)&amp;from=DE\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Directiva de la UE sobre el derecho de autor de 2004<\/a> define como direcci\u00f3n en el art\u00edculo 8 s\u00f3lo \"direcciones\". Seg\u00fan los jueces, no hay indicios de que la legislaci\u00f3n de Alemania tenga por objeto ampliar esta interpretaci\u00f3n de la Directiva de la UE para incluir m\u00e1s datos. Por lo tanto, seg\u00fan el BGH, queda excluida una \"interpretaci\u00f3n (din\u00e1mica) ulterior de la ley\", as\u00ed como una \"aplicaci\u00f3n an\u00e1loga\" de la Ley de Derecho de Autor. Tambi\u00e9n de la <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/242.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Cl\u00e1usula 242<\/a> del C\u00f3digo Civil Alem\u00e1n (BGB) no hay derecho a la informaci\u00f3n sobre \"nombre y direcci\u00f3n\" de Constantin-Film contra YouTube.<\/p>","protected":false},"excerpt":{"rendered":"<p>YouTube no tiene que revelar la direcci\u00f3n de
