V. (Bitkom) met en garde dans un <a href=\"https:\/\/www.bitkom.org\/Presse\/Presseinformation\/Brexit-Bitkom-warnt-vor-Daten-Chaos\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Communiqu\u00e9 de presse<\/a> contre la menace d'un \"chaos des donn\u00e9es\" dans le cadre du Brexit. Une phase de transition est actuellement en vigueur, pendant laquelle le <a href=\"https:\/\/webhosting.de\/fr\/recht\/\">Droit<\/a> de l'Union europ\u00e9enne (UE) continue de s'appliquer au Royaume-Uni et dans lequel le Royaume-Uni reste membre de l'Union douani\u00e8re de l'UE et du march\u00e9 int\u00e9rieur de l'UE. Cet accord expirera le 31 d\u00e9cembre 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ceci est particuli\u00e8rement important pour <a href=\"https:\/\/webhosting.de\/fr\/lhebergement-en-nuage-cloud-computing\/\">H\u00f4te des nuages<\/a> et d'autres entreprises situ\u00e9es au Royaume-Uni <a href=\"https:\/\/webhosting.de\/fr\/personenbezogene-daten-sozialen-netzwerken\/\">Donn\u00e9es<\/a> de clients de l'UE posent un probl\u00e8me, car la base juridique pour l'\u00e9change de donn\u00e9es n'existe plus.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-gro-britannien-wird-zum-drittland\">La Grande-Bretagne devient un pays tiers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Si aucun accord n'est conclu sur les futures relations entre le Royaume-Uni et l'UE, le Royaume-Uni sera class\u00e9 comme pays tiers dans le domaine de la protection des donn\u00e9es \u00e0 partir de l'ann\u00e9e prochaine. La libre circulation des donn\u00e9es entre l'Allemagne ou d'autres \u00c9tats membres de l'UE et le Royaume-Uni serait alors interdite.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>\"Le Royaume-Uni est l'un des sites les plus importants pour le traitement des donn\u00e9es, par exemple dans les domaines de la logistique, des relations avec la client\u00e8le et de la mobilit\u00e9.<\/p><cite>Achim Berg, pr\u00e9sident de Bitkom<\/cite><\/blockquote><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Selon les estimations de l'association industrielle, une brexite sans accord affecterait donc non seulement les grandes entreprises, mais aussi les moyennes entreprises et les start-ups. Les plates-formes alternatives comme la <a href=\"https:\/\/webhosting.de\/fr\/un-grand-interet-pour-linitiative-europeenne-sur-les-nuages-gaia-x\/\">Nuage Gaia-X<\/a> et le <a href=\"https:\/\/webhosting.de\/fr\/lidl-and-kaufland-launch-2021-public-cloud\/\">Nuage public de Lidl et Kaufland<\/a> sont actuellement en construction, mais l'infrastructure n\u00e9cessaire ne sera pas pr\u00eate \u00e0 temps pour prendre en charge les donn\u00e9es pr\u00e9c\u00e9demment trait\u00e9es au Royaume-Uni \u00e0 partir du 1er janvier 2021.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-ad-quanzentscheidung-der-eu-kommission-n-tig\">N\u00e9cessit\u00e9 d'une d\u00e9cision d'ad\u00e9quation de la Commission europ\u00e9enne<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Dans l'\u00e9tat actuel des n\u00e9gociations, il est tr\u00e8s peu probable qu'un accord commercial soit conclu d'ici la fin du mois. Afin de pouvoir continuer \u00e0 \u00e9changer l\u00e9galement des donn\u00e9es avec la Grande-Bretagne, bitkom exige de la Commission europ\u00e9enne une d\u00e9cision dite d'ad\u00e9quation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cela permettrait de revoir le niveau de protection des donn\u00e9es au Royaume-Uni et de continuer \u00e0 autoriser le trafic de donn\u00e9es s'il est garanti que les services en nuage y sont conformes \u00e0 la l\u00e9gislation europ\u00e9enne sur la protection des donn\u00e9es. Selon Berg, une telle d\u00e9cision d'ad\u00e9quation ne doit pas devenir un pion dans le processus de n\u00e9gociation de Brexit.
